Personally being a big fan of his Obey campaign, and other works, this poster is going in a different direction from previous works.

well at first I couldn't' believe that he ripped off the photo... but its pretty obvious now that he was at least looking at that photo :P but in all honesty I think he should of at least noted the source. I also heard that he didn't receive any kind of monetary payment for this piece... so how could he really be sued?
I'm not a shep fairey fan, but what he did has been done for years by artists. Most of Andy Warhol's stuff comes from photos he took out of newspapers. He didn't really "rip-off" the photo - it was definitely used as a source - but the inherent value of the poster isn't the image, so much as it is the color separations/style the posters was created in. It seems like "fair use" to me.
I don't get the hype really. There are tons of painting and posters based off of photographs. I agree he should have sorted the source (as anyone with professional courtesy normally does), but to be sued cuz of the likeness - I believe is just the AP gettin a lil power hungry.
